Below you are informed of the terms and conditions that regulate the access and use of our website Merkimarket.com (hereinafter, "the Site"), owned by YAURIMEKA SLU, with CIF B1399692 and email contacto@merkimarket.com .

By accessing or using the Site, the user accepts the terms and conditions. We recommend that you periodically review these terms to be informed of any changes. Merki Market reserves the right to update, modify or delete any part of the Site, as well as the right to add new products or services, at any time and without prior notice. The continued access or use of the Site by the user after the publication of modifications implies acceptance of them.

  1. Conditions of access, use and intellectual property of the Website:

The user undertakes to access and use the Site and its services responsibly and in accordance with the law, good customs and these General Conditions. The user is prohibited from accessing or using the Site and its services for illegal or unauthorized purposes, including, but not limited to, the transmission of viruses, spam, or any other action that may damage or interfere with the normal operation of the Site, and the user must respond to Merki Market in the event of non-compliance.

Any use other than the purpose of the Site is expressly prohibited.

The use made by the user of the contents of the Site, as well as the consequences, damages or losses that may arise from it, are his/her exclusive responsibility. Merki Market is not responsible for the improper use that third parties may make of the Site, nor for the information transmitted to third parties through it, nor for the damages or losses of any nature caused to users by the use of links, directories or search tools that allow access to websites belonging to or managed by third parties, as well as the presence of viruses or other malicious codes in the contents that may cause any type of damage to the computer system, electronic documents or files of users. The user must refrain from using any means intended to suppress, alter, evade or manipulate the protection devices or security systems that may be installed on the Site and that may generate risks, damage or disable the site and/or its contents.

All content, distinctive signs, brands, trade names, structure, design, form of presentation of the elements and any other information that appears on the Site, as well as the design and its source codes, are the exclusive property of Merki Market, directly or indirectly, and are protected by industrial and intellectual property rights.

Reproduction, transformation, distribution, public communication and, in general, any other form of exploitation of the elements mentioned in the previous paragraph is expressly prohibited without the prior written authorization of Merki Market.

Merki Market reserves the right to take the necessary legal action in response to any of the reported breaches by users or third parties.

 

  1. Prices:

The prices indicated on the Site include applicable taxes and shipping and delivery costs in mainland Spain and the Balearic Islands, unless otherwise indicated. To find out the shipping and delivery prices outside these areas, please contact us by email at contacto@merkimarket.com.

Prices may be modified by Merki Market at any time, respecting the rates in force at the time the order is placed and subject to availability on that date.

Merki Market may cancel the order and return the amount paid by the customer in the event of any error in the prices, provided that it is a difference that any consumer could identify as erroneous before formalizing the purchase.

 

  1. Payment Methods:

Payment can be made using the payment methods indicated in the shopping cart. To do so, the customer must follow the instructions on the screen to complete the purchase, providing the information required to process payments securely.
Available payment methods include:

  • Credit or debit card : We use a secure payment gateway that encrypts the data provided to ensure its protection, without any storage of credit or debit card data.
    Visa, Maestro, Mastercard, American Express and Union Pay cards are accepted.
  • PayPal : Payments are allowed through a PayPal account or by using this platform to process payments using credit and debit cards.
  • ShopPay: We use Shopify's payment system.

 

  • GooglePay: We use Google's payment system.
  • Bank transfer : Payment by bank transfer is permitted, except for those that entail shared costs. If the user uses this payment method, the delivery period will begin from the receipt of the transfer.
  1. Communications and Electronic Billing:

All communications between the user or customer and Merki Market will be carried out via email, thus ensuring that no important information is lost or misplaced. It is the customer's responsibility to regularly check their email in order to be aware of any information that is relevant to their order.

Purchase invoices will be sent to the customer in electronic format, as well as corrective invoices in the case of returns. The customer can request a paper copy of their invoice by contacting contacto@merkimarket.com.

 

  1. Delivery:

Merki Market will be responsible for the delivery of the products purchased by the customer to the address specified by the customer, using a transport service with delivery to the street level. Delivery times are established for each product, and we undertake to do everything possible to comply with the delivery times established for this purpose, noting that in some cases delivery within the deadline may not be possible due to circumstances beyond our control.

All dimensions of the products offered by Merki Market correspond to the actual measurements of the product, excluding transport packaging. The customer must ensure that the dimensions of the product are compatible with the access to their home or delivery location. The responsibility of verifying these measurements is exclusively that of the customer.
The customer undertakes to be present at the delivery address and on the date agreed with the transport company, as well as to inspect and verify the conformity of the order and its condition at the time of receipt.

The customer is obliged to check the order and note any visible damage to the packaging on the delivery receipt. The customer must notify Merki Market before proceeding to handle or install the product if the product received does not match the one ordered (measurements, colour, model, etc.), so that the replacement can be carried out at no cost to the customer.

Merki Market is responsible for the condition of the goods until they are delivered in compliance to the address provided by the customer, without prejudice to the applicable legal warranty rights.

Merki Market is not responsible for losses or inconveniences arising from errors in the address provided by the customer at the time of purchase, the collection of products by third parties at the indicated address or any change of address after the purchase. In the event that, due to an error in the address provided by the customer, the products are delivered to an incorrect location, and it is necessary to resend or redirect the material, the customer will assume the associated additional cost, the payment of which must be made before proceeding with the new shipment.

 

 

  1. Withdrawal and returns policy:

The customer has a withdrawal period of fourteen calendar days from receipt of the product. Any return made after this period will not be accepted. To exercise the right of withdrawal, you must contact us by email at contacto@merkimarket.com .

Returns of "custom-made", "personalised", "exclusive" or "special" products made to customer specifications will not be accepted, unless the product has an obvious manufacturing defect. Returns of sealed goods that are not suitable for health or hygiene reasons and that have been unsealed after delivery will also not be accepted.

The customer must return the product in optimal condition. The return or replacement of products that have been installed and/or manipulated by the customer, that have not been used for the simple verification of their condition and operation, and that, therefore, cannot be resold, will not be accepted. The customer must return the product in its original packaging. The customer is prohibited from using adhesive tape or seals directly on the product.

Shipping costs arising from the return of the goods will be borne by the customer, so returns with postage due will not be accepted, unless there is a manufacturing defect.

When the product must be returned to the warehouse for inspection, Merki Market will initially assume the costs of returning it to the warehouse. If the Technical Assistance Service (SAT), after the review, concludes that the product has been damaged due to improper use by the customer, the customer must pay the costs incurred by returning it to the factory and the costs of a new shipment if the customer wishes to recover the product.

In the event of withdrawal, Merki Market will reimburse, using the same payment method used by the customer, all payments received within a period of fourteen calendar days from the date on which the customer was informed of the withdrawal, except for the costs incurred by the return. In the event of a refund by payment method via transfer from a customer account without an IBAN, outside the EU, Merki Market will deduct the commission applied by the bank. Merki Market reserves the right to withhold the refund until receipt of the goods and verification of the good condition of the product.

 

  1. Cancellations:

Any order may be cancelled by sending an email to contacto@merkimarket.com , provided that it has not been shipped. If it has already been shipped, the customer must wait to receive it before proceeding with its return, provided that it complies with the conditions established for this.
Cancellation of "custom", "personalized", "exclusive" or "special" products will not be accepted.

  1. Warranty

In accordance with applicable legislation, all Merki Market products have a minimum warranty of 3 years from the date of delivery, which covers manufacturing defects and any problems that result in the product not being suitable for its intended use.
The product warranty will not apply in the event of product defects caused by negligence, impact, improper use or handling, incorrect installation or materials subject to wear and tear due to normal use.

The customer may choose between repair or replacement of the goods if they are not suitable for their intended use, are not delivered with the corresponding packaging and instructions, or do not meet the described quality, unless repair or replacement is not possible or the costs are disproportionate to this.

Repair or replacement will be free of charge, including any expenses necessary for this, as well as shipping, transport, labour or materials costs, and will be carried out within a reasonable period from the customer's notification.

If it is not possible to repair or replace the goods, the customer may demand a reduction in price or proceed to terminate the contract when it has not been possible to carry out the repair or replacement of the goods within a reasonable period.

The information provided by the Site is accurate and up-to-date, however, Merki Market does not guarantee the exact representation of the products, especially with regard to colours, whose display variations may be caused by Internet browsing programs and/or the settings of users' monitors. Furthermore, due to technological advances and designs of some products, they may present slight differences with respect to the images and descriptions published on the Site, as well as due to variations in the manufacturing process, resulting in the product received may not be completely identical to that represented on the Site. Therefore, Merki Market is not responsible for discrepancies in the colours of the products on the Site or for the absolute uniformity of the products delivered.

  1. Protection of personal data

Merki Market complies with current legislation on personal data protection security levels, by using the technical means at our disposal to prevent the loss, misuse, alteration, unauthorized access and theft of the data that the user provides through the Site.

In accordance with applicable legislation, Merki Market undertakes to comply with the duty of secrecy and confidentiality regarding the personal data contained in its automated file.

 

  1. Modification of the privacy policy

This privacy policy may be modified to adapt it to future legislative, jurisprudential or industry practice developments. Merki Market will inform users of such changes in advance.
