Below you will find the terms and conditions that govern access to and use of our website Merkimarket.com (hereinafter, "the Site"), owned by Yaurimeka S.L.U., with CIF B13996921, business address at Princesa 31, 2nd Floor, Door 3, 28008 Madrid, and email contacto@merkimarket.com.
By accessing or using the Site, the user accepts these terms and conditions. We recommend reviewing these terms periodically to stay informed of any changes. Merki Market reserves the right to update, modify, or remove any part of the Site, as well as the right to add new products or services, at any time and without prior notice. Continued access to or use of the Site by the user after the publication of modifications constitutes acceptance of such changes.
1. Conditions of Access, Use, and Intellectual Property of the Website
The user agrees to access and use the Site and its services responsibly and in accordance with the law, good practices, and these General Terms and Conditions. The user is prohibited from accessing or using the Site and its services for illegal or unauthorized purposes, including but not limited to the transmission of viruses, spam, or any other action that may damage or interfere with the normal functioning of the Site. The user shall be held liable to Merki Market in the event of non-compliance with these obligations.
The use of the Site for purposes other than those intended is strictly prohibited.
The user is solely responsible for the use made of the Site’s contents, as well as for any consequences, damages, or harm that may arise from such use. Merki Market is not liable for the improper use of the Site by third parties, for the information transmitted to third parties through it, or for any damages of any kind caused to users by the use of links, directories, or search tools that allow access to websites owned or managed by third parties, nor for the presence of viruses or other malicious code in the contents that may cause any type of damage to users’ computer systems, electronic documents, or files.
The user must refrain from using any means aimed at removing, altering, bypassing, or tampering with the protection devices or security systems that may be installed on the Site and that could generate risks, damages, or disablement of the Site and/or its contents.
All contents, distinctive signs, trademarks, trade names, structure, design, presentation of elements, and any other information appearing on the Site, as well as the design and its source codes, are the exclusive property of Merki Market, either directly or indirectly, and are protected by industrial and intellectual property rights.
The reproduction, transformation, distribution, public communication, and, in general, any other form of exploitation of the elements mentioned above is strictly prohibited without the prior written authorization of Merki Market.
Merki Market reserves the right to take any necessary legal action in response to non-compliance by users or third parties.
2. Prices
The prices indicated on the Site include applicable taxes and shipping and delivery costs within mainland Spain and the Balearic Islands, unless otherwise stated. For shipping and delivery prices outside these areas, inquiries must be made via email at contacto@merkimarket.com.
Prices may be modified by Merki Market at any time, while respecting the rates in force at the time the order is placed and subject to availability on that date.
Merki Market may cancel the order and refund the amount paid by the customer in the event of a pricing error, provided that the difference is such that any consumer could reasonably identify it as a mistake before finalizing the purchase.
3. Payment Methods
Payment may be made through the payment methods indicated in the shopping cart. To this end, the customer must follow the on-screen instructions to complete the process, providing the required information to securely process payments.
The available payment methods include:
● Credit or Debit Card: We use a secure payment gateway that encrypts the provided data to ensure protection, without storing any credit or debit card details.
Accepted cards: Visa, Maestro, Mastercard, American Express, and UnionPay.
● PayPal: Payments can be made using a PayPal account or by using this platform to process credit and debit card payments.
● ShopPay: We use Shopify’s payment system.
● GooglePay: We use Google’s payment system.
● ApplePay: We use Apple’s payment system.
● Bank Transfer: You may order payment to the bank account displayed when selecting the bank transfer payment option.
4. Communications and Electronic Invoicing
All communications between the user or customer and Merki Market will be carried out via email, thus ensuring that no important information is lost or misplaced. It is the customer’s responsibility to regularly check their email in order to stay informed about any relevant details regarding their order.
Purchase invoices will be sent to the customer in electronic format, as well as corrective invoices in case of returns. The customer may request a paper copy of the invoice by contacting contacto@merkimarket.com.
5. Delivery
Merki Market will handle the delivery of products purchased by the customer to the address specified by them, using a transport service with curbside delivery. Delivery times are indicated for each product, and we are committed to doing our best to meet the established delivery deadlines, while noting that in some cases delivery within the specified period may not be possible due to circumstances beyond our control.
All product dimensions offered by Merki Market correspond to the actual measurements of the product, excluding transport packaging. The customer must ensure that the product dimensions are compatible with the access points of their home or delivery location. Responsibility for verifying these measurements lies exclusively with the customer.
The customer agrees to be present at the delivery address on the agreed date with the transport company, as well as to inspect and verify the order’s conformity and condition at the time of receipt.
The customer is required to review the order and note on the delivery receipt any visible damage to the packaging. If the received product does not match the order (dimensions, color, model, etc.), the customer must notify Merki Market before handling or installing the product so that it can be replaced at no cost to the customer.
Merki Market is responsible for the condition of the goods until delivery and acceptance at the address provided by the customer, without prejudice to the applicable legal warranty rights.
Merki Market is not liable for losses or inconveniences arising from errors in the address provided by the customer at the time of purchase, product collection by third parties at the indicated address, or any change of address after purchase. If, due to an incorrect address provided by the customer, the products are delivered to an incorrect location and need to be resent or redirected, the customer shall bear the additional costs, which must be paid before the new shipment is processed.
6. Withdrawal and Returns Policy
The customer has a withdrawal period of fourteen (14) calendar days from the receipt of the product. Any return made after this period will not be accepted. To exercise the right of withdrawal, the customer must communicate it via email to contacto@merkimarket.com.
Returns of “made-to-measure,” “personalized,” “exclusive,” or “special” products manufactured according to the customer’s specifications will not be accepted, except in cases where the product presents an obvious manufacturing defect. Returns will also not be accepted for sealed goods that are not suitable for return for reasons of health or hygiene and that have been unsealed after delivery.
The customer must return the product in perfect condition. Returns or replacements will not be accepted for products that have been installed and/or manipulated by the customer, whose use has gone beyond the simple verification of their condition and operation, and which therefore cannot be resold. The customer must return the product in its original packaging. The use of adhesive tape or seals directly on the product is strictly prohibited.
The shipping costs arising from the return of goods will be borne by the customer; returns sent freight collect will not be accepted, except where there is a manufacturing defect.
When the item needs to be returned to the warehouse for inspection, Merki Market will initially cover the shipping costs back to the warehouse. However, if the Technical Support Service (TSS), after inspection, concludes that the product was damaged due to improper use by the customer, the customer shall bear the costs incurred for shipping the product back to the factory as well as the costs of a new shipment if they wish to recover the product.
In the event of withdrawal, Merki Market will reimburse all payments received (excluding costs incurred due to the return), using the same payment method employed by the customer, within fourteen (14) calendar days from the date the withdrawal was communicated by the customer. In the case of refunds via bank transfer to an account without an IBAN, outside the EU, Merki Market will deduct the commission charged by the bank. Merki Market reserves the right to withhold the refund until the goods have been received and their good condition verified.
7. Order Cancellations
Any order may be canceled by sending an email to contacto@merkimarket.com, provided that it has not yet been shipped. If the order has already been shipped, the customer must wait to receive it and then proceed with a return, provided that the established conditions for returns are met.
Cancellation will not be accepted for “made-to-measure,” “personalized,” “exclusive,” or “special” products.
8. Warranty
In accordance with applicable legislation, all Merki Market products carry a minimum warranty of 3 years from the date of delivery, covering manufacturing defects and any issues that render the product unsuitable for its intended use.
The product warranty does not apply in cases of product deficiencies caused by negligence, impacts, improper use or handling, incorrect installation, or materials subject to wear and tear from normal use.
If a product is not suitable for its intended use, is not delivered with the corresponding packaging and instructions, or does not meet the described quality, the customer may choose between repair or replacement, unless such repair or replacement is not possible or would entail disproportionate costs.
Repair or replacement will be provided free of charge, including all necessary expenses such as shipping, transportation, labor, or materials, and will be carried out within a reasonable period from the time the customer reports the issue.
If repair or replacement is not possible, the customer may request a price reduction or terminate the contract if repair or replacement cannot be carried out within a reasonable period.
The information provided on the Website is accurate and up to date; however, Merki Market does not guarantee the exact representation of products, particularly regarding colors, as variations in display may occur due to internet browsing software and/or users’ monitor settings. Furthermore, due to technological advancements and design updates in some products, there may be slight differences compared to the images and descriptions published on the Website, as well as variations in the manufacturing process, meaning that the received product may not be identical to the one represented online. Therefore, Merki Market is not responsible for discrepancies in product colors shown on the Website or for absolute uniformity of delivered products.
9. Personal Data Protection
Merki Market complies with current legislation regarding personal data protection and applies security measures within our technical capacity to prevent loss, misuse, alteration, unauthorized access, or theft of the data provided by users through the Website.
In accordance with applicable legislation, Merki Market undertakes to maintain the duty of secrecy and confidentiality regarding the personal data contained in its automated files.
10. Modification of the Privacy Policy
This Privacy Policy may be modified to adapt it to future legislative, jurisprudential, or industry practice updates. Merki Market will notify users in advance of any such changes.
